Act on Promotion of Information and Communications Network Utilization and Information Protection, etc., Article 50 (Restrictions on Transmission of Advertising Information for Profit)

• Anyone who sends advertising information for profit by electronic transmission media must obtain the recipient's explicit prior consent (paragraph 1). Violations are subject to an administrative fine of up to 30 million won (Article 76 (1) 7).
• A person sending advertising information must not automatically generate recipients' contact details, such as phone numbers or email addresses, or automatically register phone numbers or email addresses for the purpose of sending advertisements (paragraph 5). Violations are punishable by imprisonment of up to one year or a fine of up to 10 million won (Article 74 (1) 4).
